An early Monday morning drive proved too slick for a suspect to slide out of his fourth DUI charge.

David A. Forkum was charged with his fourth DUI, fourth driving on a revoked license, implied consent, disorderly conduct and leaving the scene of an accident. Forkum was also issued citations for failure to carry a driver's license and financial responsibility.

Deputy Drew Colwell was dispatched at 1:50 a.m. on Jan. 6 to an address on Old Prospect Road in reference to a white or silver Mustang that had slid into a ditch.

"As I was about to arrive on scene I was notified that the car had been pulled out of the ditch and that the subject ripped off the front bumper and left it in the yard at either 30 or 57 Old Prospect Road and was headed toward Iconium with two male subjects throwing beer cans out the window," Colwell reported.

Colwell drove through the area and initially made no contact with the vehicle until he hit Iconium Road and spotted a silver Mustang that was missing its front bumper. The deputy had to turn around and then followed the Mustang as it turned onto icy Old Prospect Road.

When Colwell next saw the Mustang it had wrecked in the front yard of 286 Old Prospect. Two male suspects were walking away from the vehicle.

"I identified the suspects to be David A. Forkum (vehicle driver) and Thomas Robert Hurst (vehicle passenger). I asked Mr. Forkum if he had been drinking and he said no that he had only had a Dr. Pepper," Colwell said.

"Mr. Forkum's speech was slurred and he was unsteady on his feet. When asked about wrecking the car he stated that he knew nothing about it that it was not his vehicle and he had not seen it before," the deputy said.

Forkum told Colwell he had no identification and responded to the deputy's order to stay put by cursing and walking off.

"At this time the road was iced over and backup units were on the way and I stayed and questioned the passenger, Mr. Hurst," Colwell said.

Mr. Hurst had a different story to tell.

Hurst told the deputy that Forkum had been driving too fast on the icy road and lost control of the Mustang. He also told Colwell that Forkum was drinking and had previously run off in the ditch about 30 minutes earlier on Old Prospect.

Colwell secured Hurst in the rear of his patrol unit and started looking for Forkum.

Once again on Iconium Road, the deputy spotted a gold-colored mini-van, which he stopped to see if they had given Forkum a ride.

"As I exited my patrol car, Mr. Forkum got out of the passenger seat of the van," Colwell said. The suspect was taken into custody and the deputy drove back to the crash scene.

Icy conditions and Forkum's disposition made it impossible for Colwell to conduct field sobriety tests on Old Prospect Road.
