NOTICE FORECLOSURE SALE
CANNON COUNTY, STATE OF TENNESSEE
This is an attempt to collect a debt. Any information obtained will be used for that purpose.
Default has been made in the terms, conditions and payments provided for in that certain Deed of Trust dated May 12, 2000, of record in Deed Book/Page Number   2 / 108, Instrument 1761, Register's Office for Cannon County, Tennessee, from Ruby Carol Johnson and David  Allen Johnson (Borrower) to Superior Title Company Inc.  (Trustee) for the benefit of Metwest Mortgage Services, Inc. (Lender), securing the Note/indebtedness therein described, the entire Note/indebtedness having been declared in default and immediately due and payable by the lawful owner and holder thereof.
The Bank of New York Mellon, as Trustee, pursuant to the terms of that certain pooling and servicing agreement dated as of September 1, 2000, related to Metropolitan Mortgage Funding, INC., mortgage pass-through certificates, series 2000-B (Holder), now being the present owner/holder of said indebtedness, has now requested that foreclosure proceedings be instituted, and said Holder has appointed the firm listed below as Successor Trustee under said Deed of Trust, by an instrument duly recorded in the aforesaid records, to serve in the place and stead of the aforementioned Trustee.  Notice of the Right to Foreclose was sent to the Borrower by letter dated March 14, 2011.
Now, therefore, said Successor Trustee, or agent thereof, pursuant to said Deed of Trust, having been requested by the Holder so to do, and by virtue of the authority and power vested in said Successor Trustee by said Deed of Trust,  will on October 18, 2011 at 1:00 p.m., at the usual and customary location at the Cannon County, Tennessee, Courthouse, sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), the following-described property:
Bounded on the north by lands of Carl M. Knox and George Knox, the lands of James B. Field; bounded on the south by the lands of Craig Crump, the lands of Fred E. Hollis, and a private road; bounded on the east by the lands of Jerry Dell Harrell and Russell Thomas; and, bounded on the west by the lands of James B. Field, lands of Loran R. Laxon, and the Bradyville Public Road, containing 170 acres, more or less.
Together With 1994 CAVA MH VIN # ALCA0394556S19810A, including, but not limited to, all fixtures, attachments and accessions attached hereto or hereafter acquired.
For identification purposes only, see Map 63, Parcel 6.02 office of the County Tax Assessor.
Being the same property conveyed to David Allen Johnson and wife, Ruby Carol Johnson by Deed from Annie Alsup Stuart, a widow and Lura Alsup Roger, a widow of Record on Book 163, Page 224, Register's Office for Cannon County, Tennessee.
For informational purposes only, this property is commonly known as 167 Stuarts Lane, Bradyville, TN 37026, Parcel ID 063 03400 000000.
The property shall be free from all right and equity of redemption, statutory or otherwise, homestead, dower, curtesy, elective share, and all other exemptions that are expressly waived in said Deed of Trust, and the title is believed to be good, but the Successor Trustee will sell and convey only as Successor Trustee, "as is" and "where is" and without covenants of seizin or warranties of title.

This sale is subject to liens; easements; encumbrances; property taxes; rights of redemption of taxing entities; all matters shown on any recorded plan(s) or plat(s); any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; any matter that an accurate survey of the premises might disclose; and other matters which are prior in right to the lien of the aforesaid Deed of Trust.
If a high bidder fails to close a sale, the Successor Trustee shall have the option of making the sale to the next highest bidder.  The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time.  The right is reserved to adjourn the sale to another day, time and/or place certain without further publication, upon announcement at the time and place for the sale set forth above, or at any date and time fixed by a preceding postponement.  Alternatively, at its option, Successor Trustee may give a new notice of sale.

SUCCESSOR TRUSTEE'S NOTICE OF SALE
OF REAL ESTATE AND AFFIXED MANUFACTURED HOME
WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust executed on January 24, 2004, by RAYMOND EARL McVAY, JR., a single person, to Kevin T. Clayton, Trustee, as same appears of record in the Register's Office of Cannon County, Tennessee, at Book 53, Page 748, ("Deed of Trust"); and
WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to Vanderbilt Mortgage and Finance, Inc.;

The Woodbury Planning Commission will meet in regular session Tuesday, October 18, 2011 at 6:00 P.M. at Woodbury City Hall.

Taking Bids For Communications Tower
Cannon County is taking bids for a proposed 180' self supporting communications tower to be constructed on Pleasant Ridge Road.

Two bidding options are available.

Option 1:
Bid 1, Construction of a 180' self supporting tower and adjunct equipment as follows.
- Diesel powered 20kW power backup generator with concrete foundation.
- 12 X 20 prefabricated communications building with concrete foundation.
- 50' X 35' chain link security fence, with gate.
- All electrical wiring not supplied by the above mentioned projects.
- Installation of gravel on access road and areas not covered by concrete.  

Option 2: Separate bids for the following projects,
Bid 1- Construction of a 180' self supporting tower with foundation.
Bid 2- 20 kW diesel powered generator.
Bid 3- Concrete pad foundations for communications building and backup generator.
Bid 4- 50' X 35" chain link security fence with gate.
Bid 5- Installation of underground electrical conduit from power pole to the site, electrical installation from the backup generator to the communications building. All other electrical not specified in the other bids specs.
Bid 6- Installation of gravel on access road and areas not covered by concrete.  
Bid 7- 12 X 20 prefabricated communications building, building prewired with backup generator transfer switch.

A site visit will be required prior to bid submittal.
Bid deadline will be October 25, 2011, 2:00 pm
Bid opening will be on October 27, 2011, 2:00 pm in the County Executive's Office.
