The Town of Woodbury Board of Mayor and Aldermen will meet in "SPECIAL SESSION" on Thursday, August 23, 2012 at 6:00 p.m. at Woodbury City Hall.

The purpose of the meeting is to consider an ordinance on first reading regarding registered "Nonresident" property owners voting in municipal elections. The meeting is open to the public.

The wording of the proposed ordinance is as follows:

WHEREAS, The Charter for the Town of Woodbury, Section 3, states in part:

All persons owning real estate in said town but residing without its limits who would be qualified to vote for members of the General Assembly of the State of Tennessee shall be qualified to vote for Mayor and Alderman and in all town and municipal elections; and

WHEREAS, TCA 2-2-107 states that cities with nonresident voters may pass an ordinance stating that those voters must vote by absentee ballot; and

WHEREAS, The Board of Mayor and Alderman of the Town of Woodbury wish to adopt an ordinance as called for in TCA 2-2-107;

NOW THEREFORE, THE BOARD OF MAYOR AND ALDERMAN OF THE TOWN OF WOODBURY HEREBY DECREES, PURSUANT TO TCA 2-6-205 THAT:

SECTION 1:  Nonresident voters shall vote by absentee ballot only in Town elections.

SECTION 2:  In accordance with this law, the Board requests that the Cannon County Election Commission mail notices of this requirement to said registered nonresident voters 45 days prior to the next election.

SECTION 3:  This ordinance shall take effect immediately upon final passage, the public welfare requiring it.

As I understand it, it is an attempt to lesson potential confusion for voters and the election office as well.

Persons who live in the county but own property in Woodbury can vote in the town election (mayor and aldermen).

However, if those county dwellers who own town property go to their county polling places (Woodland, West Side, Short Mountain, etc.) the town election candidates will not be on the ballot.

If they go to two polling places on the same day to vote that might cause problems for the election workers.

Therefore, the solution being proposed is to have the county dwellers who can vote in the town election do so by absentee ballot.

That is how I understood what was stated to me. I will provide additional information if I am contacted with clarifications.
