NASHVILLE – The Tennessee Center for Policy Research (TCPR) applauds the House of Representatives for passing the “Health Care Freedom Act” Monday evening. Once signed by the governor, the act will safeguard Tennesseans from the unconstitutional federal healthcare law that has become notoriously known as ObamaCare.

The “Health Care Freedom Act” protects the right of Tennesseans to participate or not in any healthcare system, and prohibits the government from imposing fines or penalties for that decision. It also protects the right of individuals to purchase—and the right of doctors to provide—lawful medical services without government fine or penalty.

“This is a very important day for Tennesseans, as the date draws near that the federal government will force them to purchase health insurance,” said TCPR president Justin Owen. “This new law will provide Tennesseans with additional recourse against what two federal judges have already ruled to be an unconstitutional mandate. We were honored to have played a role in securing this protection for our fellow citizens.”

TCPR congratulates the main sponsors of the legislation, Sen. Mae Beavers and Rep. Terri Lynn Weaver, as well as others who have worked tirelessly on the measure. The full list of co-sponsors can be viewed at www.capitol.tn.gov.

The Senate passed the bill in February by a bipartisan vote of 21-10. It passed overwhelmingly on the House floor tonight. The bill now goes to Governor Bill Haslam for final approval.

Tennessee joins Virginia, Idaho, Arizona, Georgia, Louisiana, Missouri, and Oklahoma as the first eight states to pass a law or constitutional amendment protecting the healthcare choices of their citizens.

“It’s refreshing to see Tennessee lawmakers take a stand against the unconstitutional federal healthcare mandate,” said Christie Herrera of the American Legislative Exchange Council, the main proponent of this and similar legislation across the nation. “We thank the General Assembly for addressing this important issue before the true implications of ObamaCare hit home.”

"two federal judges have already ruled to be an unconstitutional mandate" and one of those issued a stay on his ruling and three, yes, that is correct--three, judges have ruled the Act is constitutional.

Secessionists, dormant for decades, coming alive again.

Who cares what the federal judges have ruled because the ultimate decision will lie with the Supreme Court, which I believe will also find the law Un-Constitutional.

And daily, if Obama wasn't worried about the law being declared Un-Constitutional then he wouldn't be craw fishing and trying to smooth things over with the States right now.

Congress does not have the power under the Commerce Law, as they want the average American to think they do, to REQUIRE anyone to purchase anything. That in itself makes the law Un-Constitutional and if you can't see that then you are more blind than I thought!

The GOP has NO solutions to health care on the state or national level. Their only answer is that "not everyone needs health care," and "they can pay for it themselves directly through providers." Obviously they're not working minimum wage jobs that don't provide health care, or they're not students over the age of 21 who don't have health care anymore. They're not the average person who goes to a health insurance provider who wants $300 plus a month for health care insurance when they're making $500 a week before taxes, or have to support a child.
The arguments that people make against having a national health care plan are foolish. When are Americans going to understand that the Republican Party ONLY cares about rich people? The average income in the U.S. is around 45K. A lot of people make a lot less than that and cannot afford health care. Yes, the Obama plan isn't perfect, but it's better than simply repealing it and not providing ANY health care to people who can't get it. Wake up GOP supporters. Your party needs to come up with a workable alternative, not just act like children and undo everything the opposing party comes up with.
Once TN bows out of national health care, insurance companies in the state will not have to insure those they deem "uninsurable" because of pre-existing conditions (if you had cancer and couldn't previously get health care you can under the national plan). College students or young adults up to 26 can get health insurance through their parents' plan under National health care. What about young adults with diabetes, or asthma who are in that situation?
The GOP's answer: "Too bad" - that's the wrong answer.

The solution to our health care crisis is simple. People need to take personal responsibility for the health of their bodies. Until we allow insurance companies to charge more for people with higher risks (like obesity and smoking), the crisis will continue to get worse.

If people had to pay significantly more for health care (for non-hereditary, self-inflicted conditions), they would put down the twinky and hit the gym.

blooeyes it is obvious you are a Democrat and very anti-Republican and definitely within your rights and prerogative to be that way.

However, I do find people like yourself who are so "anti" or so "against" a particular party 9 times out of 10 don't always look at the complete set of facts that are readily available.

The Obama plan is and will be ruled un-Constitutional. Of that, you and everyone else can have no doubt. It will be because Congress (Democrats) over reached their powers by forcing the American people to purchase goods and services they deemed fit. This is not within their power to do.

Your misrepresentation that Republicans: "The GOP has NO solutions to health care on the state or national level" is false and not true in any way. House Republicans have had a Health Care plan in place for months and has been scored by the CBO.

You say the GOP answer is "Too Bad" and I say the Democrat's answer is to bankrupt the government with an inept plan that forces people to purchase a government approved plan that is un-Constitutional and uses taxpayer dollars to fund abortions because people choose not to act responsible.

The funny thing about government that decides it has the power to force it's people into making decisions it sees fit and disregards their opinions is they tend to find the people soon get rid of the government itself.

How do you think that scenario worked for communist Russia, or Egypt or now Libya?

There is a compromise somewhere in the middle for everyone to benefit from. But, it is not going to come from radicals from either party.

You can blame until the cows come home, but at the end of the day the Democrats have as much to blame for not creating something viable as the Republicans do.

And in reality, what is it getting you or me to blame the other party? It certainly isn't solving any problems.
