SUBSTITUTE TRUSTEE’S SALE
Default having been made in the terms, conditions, provisions and payments made and provided for in a deed of trust dated September 6, 2007, executed by Robert S. Slatton, Jr. and Jamie Slatton, to Investors Title Company, as Trustee, and recorded in Book 103, Page 11, of record in the Register’s Office for Cannon County, Tennessee, to secure the indebtedness therein described, and the entire indebtedness having been called due and payable as provided in said deed of trust, and said payment not having been made, and the lawful owner and holder of said indebtedness having appointed the undersigned, David G. Mangum, as substitute trustee by written instrument dated July 13, 2010 recorded in Book 127, Page 52, in the above mentioned Register’s Office, notice is hereby given that I, the undersigned substitute trustee, or my designated agent, under the power and authority vested in me by said deed of trust, and having been requested to do so by the lawful owner and holder of said debt, will on Wednesday, August 18, 2010 at 3:45 PM, at the front entrance of the Courthouse in Woodbury, Cannon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from the equity of redemption, homestead and dower, and all other exemptions and rights of every kind, all of which are expressly waived in said deed of trust, the following described tract or parcel of land situated and lying in Cannon County, Tennessee, and more particularly described as follows, to-wit:
FRONTING on the East side of Tennessee State Highway #53, approximately five miles South of Woodbury, and beginning on an iron pin in the East margin of said Highway, Reed’s Northwest corner with Spurlock; running thence about East with Spurlock’s line 484 feet to a poplar tree; running thence about South 440 feet along a gulley to a hickory tree; running thence about West 275 feet along a gulley to a hickory tree in the East margin of said highway; running thence about North with the margin of said highway 330 feet to the point of beginning, containing three (3) acres, more or less, by estimation.

Being the same property conveyed to Robert S. Slatton, Jr. and wife, Jamie Slatton by deed from Jana Reigle dated September 6, 2007, of record in Book 103, Page 9, Register’s Office for Cannon County, Tennessee.
This description was taken from the deed of trust being foreclosed on of record in Book 103, Page 11, said Register’s Office.

SUBJECT to any and all existing easements, setback lines and restrictive covenants of record in said Register’s Office.
This sale is subject to any and all unpaid real estate taxes; restrictive covenants, easements and setback lines; any and all redemption rights, including rights of redemption of any governmental agency, State or Federal; and any and all other prior liens or encumbrances against said real property. Said sale is further subject to matters that an accurate survey of the property might disclose.
The property sold pursuant to this notice shall be sold “AS IS” and neither the Substitute Trustee nor the beneficiary of the Deed of Trust, nor any agent or attorney therefore, makes or shall make any warranty, whether express or implied, as to the condition, quality or quantity thereof, including, but not limited to, the enforceability of any lease affecting the property, the existence or absence of defaults under or the effect or this sale upon the rights of any party under such lease.  The Substitute Trustee shall make no warranty of title, express or implied, and will sell and convey the subject real property by Substitute Trustee’s Deed only.
The Substitute Trustee may adjourn or postpone the aforementioned sale of real property by public announcement at such time and place of sale, and from time to time thereafter may postpone such sale by public announcement at the time and place fixed by the preceding postponement or subsequently noticed sale, and without further notice make such sale at the time fixed by the last postponement, or may, in its discretion, give a new notice of sale.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and, if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof.  The proceeds derived from the sale of the property will be applied as provided for in said deed of trust.

NOTICE OF PROPERTY FOR SALE
The property is being offered for sale to those individuals whom the Farm Service Agency (FSA) considers qualified beginning and/or socially disadvantaged farmers or ranchers, and all prevailing claimants in the civil action Pigford vs. Vilsack.  Prevailing claimants who are qualified beginning and/or socially disadvantaged farmers or ranchers will be given first priority consideration in the purchase of this property. If more than one beginning and/or socially disadvantaged farmer or rancher or more than one of a combination of both who are prevailing claimants submit an application, priority within this group will be determined by lottery. Qualified beginning and socially disadvantaged farmers or ranchers must be in need of FSA credit assistance either in the form of direct FSA financing or an FSA guaranteed loan. The property is located in Warren County.  The property is  8  miles west from McMinnville, TN.  The property contains a shop and storage shed.  The legal description is:  Beginning on an iron pin in the south margin of Unity Road Bratcher’s northwest corner; thence with Bratcher’s line south 07 deg. 24’ West, 1939.84 feet to an iron pin in a drainage easement, Vaughn’s northeast corner; thence with Vaughn’s line south 88 deg. 36’ West 652.35 feet to an iron pin; thence north 07 deg. 24’ East 2047.93 feet to an iron pin in the south margin of Unity Road; thence with Unity Road south 81 deg. 52’ East 645 feet to the place of beginning.  Containing 29.52 acres, more or less.  Being Tracts 1, 2, 3 of the Bratcher property by survey by Thaxton & Bartlett, dated March 25, 1987.
Property will be sold “as is”.  The purchase price is $116,000.00.  The Government reserves the right to cancel the sale at any time during the sale process and also reserves the right to reject any or all applications or bids.

Do You Need Help Paying Your Rent?
The Housing Choice Voucher program provides rental assistance to very low-income persons. Tennessee Housing Development Agency administers the program in many counties. Pre-applications are being accepted beginning 08/01/2010 at 6:00 a.m. to 08/07/2010 at 11:59 p.m. for the Housing Choice Voucher program in Cannon County. All applicants must be income-eligible to qualify.

Please note that our pre-application process has changed. Pre-applications are taken on line with any computer with internet access through wwww.thda.org. Click on the link to the Rental Assistance Housing Choice Voucher page and follow the directions. If you need to request a reasonable accommodation, please call the Cookeville field office at 931-520-0608. A TDD line is available for the hearing impaired at 615-532-2894.

All pre-applications must be submitted on the THDA website.
No pre-applications are to be given out, received in person, or by mail.

NOTICE OF HOME SCHOOL

Any parents/legal guardians who intend to conduct an Independent Home School, grades K-12, or a Church-Related Home School, grades K-12, for their own children, during the 2010-2011 School Year must notify their local public school director’s office by August 1, 2010. This requirement applies to previous home school parents and new ones alike.
Home School Registration forms for the 2010-2011 School Year are available at the Cannon County School Director’s office, and upon completion, should be returned to the Director of School’s office by August 1, 2010 at 301 West Main Street, Woodbury, TN 37190.

Any parent/legal guardian wishing to conduct a Home School for grades K-12 must provide 1) proof of legal custody or guardianship by a copy of child’s birth certificate or court order, and 2) copy of a high school diploma or GED for grades K-8 and BA degree for grades K-12.

If you have any questions regarding home schools, please call 563-5752 or 563-5029 between the hours of 8:00 a.m. and 3:00 p.m.
