Wreck leads to guilty pleas



Two people from Lebanon who were involved in a Christmas Day accident on Stones River Road pleaded guilty to charges brought against them in Cannon County General Sessions Court on Jan. 2.

Brian Alan McKnight pleaded guilty to DUI first offense. Officers noted a strong odor of alcoholic beverage on his breath. He stated he had two beers before driving. He stopped the field sobriety test and stated he needed to "go to jail for DUI."

McKnight was given a partially suspended sentence of 11 months, 29 days and sentenced to serve 8 days in jail. He was also placed on probation for 11 months, 29 days, fined $350, ordered to pay the costs and his license was suspended for one year.

A passenger in McKnight's vehicle, Katie Sutpen, pleaded guilty to public intoxication and was sentenced to serve eight days in jail and ordered to pay the court costs. Warrants state Sutpan was very intoxicated and was unable to stand without falling. She was loud and using profanity. She was too intoxicated to attempt a field sobriety test and peed in the backseat of the patrol car. A charge of disorderly conduct against Sutpen was dismissed subject to good and lawful conduct.

In other cases:

• Charles F. Luebbe pleaded guilty to domestic assault with bodily injury. Luebbe was arrested on Dec. 24 after the victim took out a complaint which stated that on Dec. 22 Luebbe hit her and pulled her down to the floor, twist her arm and spit in her face. He was given a partially suspended sentence of 11 months, 29 days. Luebbe was ordered to serve 9 days in jail. He was placed on probation for 11 months, 20 days and ordered to pay the court costs. Luebbe was also ordered undergo a DVI (domestic violence inventory) assessment as well as an alcohol and drug assessment. As a result of the domestic violation guilty plea, Luebbe is prohibited from owning or possessing a firearm.

• Joshua McMackins, Readyville, pleaded guilty to domestic assault. The victim obtained a complaint against McMackins on Nov. 9 stating he physically attacked her while he was "high on drugs" and took her phone so that she could not call for help, and laid down in front of her vehicle when she tried to leave. McMackins was given a partially suspended sentence of 11 months, 29 days and was sentenced to serve four days in jail. He was placed on probation for 11 months, 25 says. McMackins also pleaded guilty to vandalism under $500. He broke the complainant's phone, TV and a bar stool. He was given a suspended sentence of 11 months, 29 days and was placed on probation for an equal amount of time. The sentences will run consecutively. McMackins was ordered to pay the court costs in both cases, have no contact with the victim, pay restitution to the victim, undergo Domestic Violence Inventory (DVI) and alcohol and drug assessments, and is barred from owning or possessing a firearm.

• Mandi Jo Mathews agreed to revocation for violation of probation. She was ordered to serve 60 days in jail. She will be back on probation for 8 month, 27 days upon release. Mathews also agreed to serve her entire sentence and not make a request for a suspended sentence if she violates her probation again.

• James A. Walls agreed to revocation for violation of probation. He was ordered to serve 60 days in jail and then will be back on probation for 10 months, 15 days. Walls will serve his entire sentence if he violates probation again.

• Amber Tucker agreed to revocation for violation of probation. She was sentenced to 60 days in jail and upon release she will be back on probation for 8 months, 29 days.

• Brittany E. Jernigan agreed to revocation for violation of probation. She was ordered to serve her entire sentence of 11 months, 29 days.

• Colleen Burlison admitted to guilt and entered into an agreed order of retirement for 11 months, 29 days on a charge of livestock (horses) at large. She was ordered to keep the horses contained and to pay the court costs.

• Jonathan Ryan Smith and Ryan Blake Foster each had a charge of vandalism dismissed, subject to good and lawful conduct. They had been charged with trashing the inside of a vehicle on Dec. 23 in a warrant obtained by the victim.

• Jendee L. Howell admitted to guilt and entered into an agreed order of retirement on a worthless check charge. She was placed on probation for 11 months, 29 days and ordered to pay court costs and restitution.
