Man Pleads Insanity To Reckless Endangerment



A Liberty man who opened fire on eight Cannon County deputies in April of last year pled not guilty by reason of insanity to Reckless Endangerment By Use Of A Deadly Weapon in Cannon County Circuit Court on Friday, March 9.

Judge Don Ash ordered James Kaiser to forfeit weapons seized and to continue to attend his treatment programs.

According to a letter-to-the-editor from his wife published in May of 2011, Kaiser is a Disabled American Veteran (DAV) who on April 16, 2011 had a flashback. He has PTSD, chronic depression, COPD, diabetes with neuropathy, esoph cancer, and high blood pressure.

In other cases heard by Judge Ash Friday:

• Russell D. Walls pled guilty to DUI. He received a partially suspended sentence of 11 months, 29 days, was ordered to serve 2 days in jail, was placed on probation for 11 months, 29 days, and order to pay a $350 fine and court costs. He will also lose his license for 1 year.

• Michael Brian Davis pled guilty to Driving While License Suspended. He received a 6-month suspended sentence, was fined $50 and ordered to pay court costs.

• Thomas E. Baxter pled guilty to Driving While License Suspended. He received a partially suspended sentence of 6 months, was ordered to serve 30 days in the county jail, was given credit for time served, and was placed on probation for 5 months. He was also fined $50 and assessed court costs.

• Jeremy Miller agreed to revocation on a charge of Violation Of Probation. He was ordered to serve 14 days in the Cannon County Jail and his probation was extended for 11 months, 15 days. He agreed to serve his entire sentence for any future violations.

• Michael Muncey had his judicial diversion on his charge of Simple Possession Of Marijuana after agreeing to revocation for violating the terms of his probation. He was given a partially suspended sentence of 11 months, 29 days and was placed on probation for 7 months, 27 days.

• Royce Foster and William Eisenmann had their cases bound over to the grand jury. Foster is charged with Domestic Assault and Theft Over $1,000. Eisenmann is charged with Aggravated Burglary, Theft Over $1,000, Simple Possession Of A Schedule II Drug, Possession of Drug Paraphernalia, Forgery (three counts), and Illegal Possession Or Fraudulent Use Of A Credit Or Debit Card.
