NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated May 23, 2007, and the Deed of Trust of even date securing the same, recorded May 24, 2007, at Book 98, Page 604 and re-recorded on May 31, 2007, at Book 98, Page 684 in Office of the Register of Deeds for Cannon County, Tennessee, executed by Mark Tillman Evans and Tina A. Evans, conveying certain property therein described to Tri-Star Title Co., LLC as Trustee for Mortgage Electronic Registration Systems, Inc., as a separate corporation that is acting solely as a nominee for PrimeLending, a PlainsCapital Company and PrimeLending, a PlainsCapital Company’s successors and assigns; and the undersigned, Shellie Wallace of Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Shellie Wallace of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on July 23, 2010 on or about 3:30 P.M., at the Cannon County Courthouse, Woodbury, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Cannon County, Tennessee, and being more particularly described as follows:
Beginning at an iron rod in the north margin of Highway 146, same being the southwest corner of the lands herein described and running thence North 02 degrees 44 minutes East 430.12 feet; North 02 degrees 05 minutes East 371.11 feet; North 06 degrees 51 minutes East 140.02; North 01 degrees 53 minutes East 91.27 feet; North 00 degrees 35 minutes West 86.14 feet; North 80 degrees 55 minutes West 6.73 feet; North 01 degrees 14 minutes West 59.76 feet; North 02 degrees 54 minutes East 199.61 feet; North 00 degrees 45 minutes West 98.31 feet, North 04 degrees 09 minutes East 153.41 feet; North 03 degrees 06 minutes West 30.26 feet; North 04 degrees 03 minutes East 250.58 feet; North 07 degrees 21 minutes East 49.36 feet; North 01 degrees 42 minutes East 248.86 feet; North 04 degrees 28 minutes East 176.28 feet; North 03 degrees 07 minutes East 153.01 feet; North 08 degrees 09 minutes East 56.67 feet; thence 100 feet to the pond, thence in a southeasterly direction, a new line, 800 feet to an iron rod, thence in a southerly direction, a new line, 660 feet to an iron rod thence in a southerly direction, a new line, 1980 feet to an iron, rod in the north margin of Highway 146, thence in a westerly direction, a new line, with Highway 146 to the point of beginning, and containing forty acres, more or less. Included in the above description, but expressly excluded from this conveyance is a 1.28 acre tract conveyed by Warranty Deed found of record in Deed Book 160, Page 274, Register’s Office for Cannon County, Tennessee. Included in the above description, but expressly excluded from this conveyance is a 2.02 acre tract conveyed by Warranty Deed found of record in Deed Book 161, Page 31, Register’s Office for Cannon County, Tennessee. Included in the above description, but expressly excluded from this conveyance is a 20.39 acre tract conveyed by Warranty Deed found of record in Deed Book 176, Page 406, Register’s Office for Cannon County, Tennessee. Included in the above description, but expressly excluded from this conveyance is a 11.87 acre tract conveyed by Warranty Deed found of record in Record Book 56, Page 195, Register’s Office for Cannon County, Tennessee. For source of title to said realty, reference is made to a certain Warranty Deed from Carl Stembridge and wife, Jennifer Stembridge, Tim Berry and wife, Barbara Berry, and Charles Berry to Mark Tillman Evans and wife, Tina A. Evans dated May 23, 2007 and recorded on May 24, 2007 in Record Book 98, Page 601, Register’s Office for Cannon County, Tennessee. This property is subject to and includes any and all lawful easements, setback lines, restrictions, etc. of record and applying to the within described property and to the zoning regulations of the appropriate governmental body.

PUBLIC HEARING NOTICE

The Woodbury Board of Zoning Appeals will be conducting a Public Hearing on Tuesday, July 20th, 2010, 6:00 p.m. at the Woodbury City Hall concerning a variance request by the Woodbury United Methodist Church located at 502 West High Street. The request is to allow a two foot-seven inch (2’-7”) extension that will bring the new addition closer to the main road. The new addition, which includes a new porch, will accommodate a lobby and a new elevator. The Board of Zoning Appeals will be looking for public input regarding the request. The public is invited to attend.
