Judge Ash Sentences Three To Serve Prison Time



Friday was plea day for most of the defendants indicted by the September, 2010 term of the Cannon County Grand Jury.  The results of Friday’s session in the Cannon County Circuit Court of Judge Don R. Ash included:

William Gary Jaco pled guilty to the charge of criminal attempt to manufacture methamphetamine over .05 grams.  He was sentenced to 4 years in prison as a Range 1, 30 percent offender.  He was ordered to serve his entire sentence, pay a $2,000.00 fine and to pay the court costs.  In another case, Jaco pled guilty to the charge of failure to register as a sex offender.  He was sentenced to 1 year in prison as a range 1, 30 percent offender and ordered to serve his entire sentence.  Jaco also pled guilty to the charge of aggravated criminal trespass.  He was sentenced to 11 months, 29 days in the county jail and ordered to serve his entire sentence.

Amanda C. Barrett pled guilty to the charge of criminal attempt to manufacture methamphetamine.  She was sentenced to 3 years in prison as a Range 1, 30 percent offender.  She was ordered to serve her entire sentence, pay a $2,000.00 fine and pay the court costs.

Milton G. Taylor pled guilty to the charge of maintaining a dwelling to keep, use or sell a controlled substance.  He was sentenced to 1 year in prison as a Range 1, 30 percent offender.  He was ordered to serve his entire sentence, pay a $2,000.00 fine and court costs.

Kimberly Young entered a conditional plea of guilty to the charge of filing a false report.  She was placed on supervised probation for 3 years, ordered to pay the court costs and ordered to attend domestic violence victim’s counseling.

Napoleon Bonaparte Wainwright’s domestic assault case was retired for 12 months upon good and lawful conduct, no assaultive behavior toward the victim and paying the court costs.  He was also ordered to attend a domestic violence program.  

Jerry Dean Barrett was reset for January 7, 2011.  He is charged with initiating the process to manufacture methamphetamine, promotion of the manufacture of methamphetamine and maintaining a dwelling to keep, use or sell methamphetamine.

Timothy Ryan Lawson was reset for December 10, 2010.  He is charged with burglary, theft and five counts of forgery, he was also appointed an attorney,

Ashley D. Davidson was reset for December 10, 2010.  She is charged with felony possession of cocaine and possession of a weapon;

Johnny E. Lyons, Jr. was reset for December 10, 2010.  He is charged with felony possession of cocaine.

Charles Matthew Gibbs was reset for December 10, 2010.  He is charged with driving under the influence, violation of implied consent law, failure to show proof of insurance and possession of untaxed alcoholic beverages;

Those defendants indicted but not listed above either failed to appear or were reset for follow-up plea day on December 10, 2010 during their arraignment in October.

• Judge Ash also presided over Cannon County Circuit Court on Friday.  Some of the results from the various cases which appeared on the docket included:
 
Jared Ian Smith was reset for December 12, 2010.  He is charged with violation of probation.
 
Roy Howell pled guilty to the charge of failure to register as a sex offender.  He was sentenced to 1 year in prison as a Range 1, 30 percent offender.  His sentence was suspended upon an equal amount of time on probation and paying the court costs.
 
Brandi Deese petition for suspended sentence was granted.  She was place on supervised probation for 3 years.  She was ordered to pay her fines and court costs at a rate of $100.00 per month.  Additionally, she was ordered to have no contact with convicted felons and attend narcotics anonomous meetings weekly.
 
Christopher Ferrell pled guilty to the charge of violation of probation.  His probation was revoked and he was ordered to serve his entire sentence.
 
Robert Mitchell Orr, III was reset for December 10, 2010.  He is charged with violation of probation.
 
Timmy Young was reset for January 7, 2011.  He is charged with violation of probation.
 
Vanessa McCormick's petition for furlough was denied by Judge Ash.
