Judge Ash Presides Over Circuit Court



Cannon County Circuit Court was held Thursday, Dec. 8 at the courthouse, with Judge Don Ash presiding. Following are the results of some of the cases on the docket:

• Benton Tyler Martin entered conditional pleas of guilty under judicial diversion to two counts of Theft Over $1,000. He was placed on state supervised probation for 3 years on each count, to run consecutive. He was also ordered to pay court costs, supervision fees and restitution to the victims in the amount of $1,325.

• David W. McPeak pled guilty to one count of Theft Over $10,000, one count of Theft Over $1,000 and to Violation of Probation. He was sentenced to a total of 10 years of state supervised probation, ordered to pay restitution, and assessed court costs.

• Amy Tribble pled guilty to Manufacture of Methamphetamine. She was placed on Community Corrections for 12 years, fined $2,000, ordered to forfeit property seized, ordered to attend alcohol and drug treatment for one years, and to serve 200 hours of community service work.

• Lucas Dobson entered a conditional plea of guilty under judicial diversion to Attempted Theft Over $10,000. He was placed on state supervised probation for 2 years, ordered to pay restitution in the amount of $8,401.91 and was assessed court costs.

• David Seiber pled guilty to Violation of Probation. His probation was reinstated for 2 years, to be state supervised. He was ordered to pay costs, fines and restitution as directed by the probation service. He agreed to serve his entire sentence if any future violations occur.

• Timothy R. Lawson pled guilty to Initiating the Process to Manufacture Methamphetamine. He was given an 11-year suspended sentence, placed on Community Corrections for 11 years, fined $2,000, and ordered to pay court costs. He will also undergo alcohol and drug treatment for 1 year. Lawson also pled guilty to Violation of Probation and was ordered to serve his entire sentence. If he violates probation again he will go to prison for 11 years. Judge Ash told the 21-year-old Lawson, “Don’t be stupid. Don’t be back here.”

• Kathleen Farless pled guilty to Violation of Probation. Her probation was extended for 11 months, 29 days. She agreed to serve her entire sentence if she violates probation again.

• Joshua Crook pled guilty to Violation of Probation. He was on judicial diversion, which was terminated. He was placed on state supervised probation for 2 years and ordered to pay court costs.

• Tony L. McPeake pled guilty to Violation of Probation. He was sentenced to serve 7 days in the Cannon County Jail and was placed back on probation for 20 months, 21 days. McPeake also pled guilty to Possession of Drug Paraphernalia. He was placed on probation for 11 months, 29 days, to run consecutive to the VOP sentence, fined $150 and assessed court costs. He also pled guilty to Driving on a Suspended License and was placed on probation for 6 months, fined $100 and his license was revoked for one year. A future probation violation will result in McPeake serving his entire sentence.

• Susan A. Blair entered a conditional plea of guilty to Filing a False Report. She was placed on judicial diversion for 2 years and ordered to pay a $100 fine and a supervision fee of $840.

• Christopher Lee Singer entered conditional pleas of guilty to Attempt to Manufacture Marijuana (over 100 plants) and to Maintaining a Dwelling to Manufacture Marijuana. He was placed on judicial diversion for a total of 10 years, fined $1,500, ordered to pay $4,080 in supervision fees and to forfeit property seized.

• John B. Carter pled guilty to Promotion of Methamphetamine Manufacture. He was sentenced to 4 years in the Tennessee Department of Corrections. That sentenced was suspended. He was placed on state supervised probation for 4 years, fined $2,000 and assessed court costs. He will also forfeit seized property.

• Audria Estes pled guilty to Facilitation of the Promotion of Methamphetamine Manufacture. She was sentenced to serve 2 years in the Tennessee Department of Corrections. That sentenced was suspended and she was placed on state supervised probation for 2 years. Estes was also fined $2,000, assessed court costs, and ordered to forfeit property seized during the investigation.

• David A. Bedwell pled guilty to Introduction of Contraband Into a Penal Institution. He was ordered to serve 30 days in the Cannon County Jail and was placed on state supervised probation for 10 years. His probation will begin after he serves his current sentences, and will run consecutive. He was also assessed court costs.

• Jacqueline L. Barrett pled guilty to Promotion of the Manufacture of Methamphetamine. She was given a 4-year suspended sentence in the Tennessee Department of Corrections and was placed on state supervised probation for an equal amount of time. She was fined $2,000, assessed court costs and ordered to attend an alcohol and drug treatment program for 1 year.

• Randall E. Council pled guilty to Sale of a Schedule III Controlled Substance. He was given a 4-year suspended sentence in the Tennessee Department of Corrections and was placed on state supervised probation for an equal amount of time. He was also fined $2,000 and assessed court costs.

• Barry W. Bynum pled guilty to Domestic Assault and to Theft Over $1,000. He received a suspended sentence of 11 months, 29 days on the Domestic Violence conviction and a suspended sentence of 4 years on the theft conviction. He was placed on state supervised probation and his probation periods will run consecutively. He was also assessed court costs and ordered to pay restitution.

• Justin Tyler Barrett pled guilty to Promotion of Methamphetamine Manufacture. He was sentenced to serve 4 years in the Tennessee Department of Corrections. That sentence was partially suspended on time served. Barrett was placed on state supervised probation for 4 years, fined $2,000, assessed court costs, and must attend an alcohol and drug treatment program for 1 year.

• Tammy Southers pled guilty to Driving on a Revoked License. She received a partially suspended sentence of 6 months in the county jail. Southers was placed on probation for 5 months, 4 days, fined $50, assessed court costs, and her license was revoked.

• Jill M. Jones pled guilty to three counts of TennCare Fraud and one count of Identity Theft. She was given 2-year suspended sentences on each charge and placed on state supervised probation for 2 years. She was ordered to pay a $100 fine and court costs on each count. She will also pay $241 in restitution.

• Richard Stickney III pled guilty to DUI. He received a partially-suspended sentence of 11 months, 29 days, an equal amount of time on probation, was ordered to serve 48 hours in jail, fined $350 and assessed court costs. His license was revoked for 1 year and he will perform 24 hours community service work.

• John McPeak pled guilty to Violation of Probation and was ordered to serve his entire sentence.

• Donald Reed, Jr. had his motion for bond reduction denied by Judge Ash. Reed is facing aggravated child rape charges.
