Tongue Thief Must Pay $3,300 In Restitution



Judge Susan Melton presided over Cannon County General Sessions Courton Tuesday. Some of the results of the various cases that appeared on the docket included:

Cody C. Fricks pled guilty under judicial diversion to 3 counts of theft under $500. He was sentenced to 11 months, 29 days in jail. That sentence was suspended upon serving two years probation, paying $3,300 in restitution to the victims and paying the costs.

On March 5, Nickey Fricks of 151 Parker Rd., Bradyville, reported the theft of two 6-foot tongues from underneath his house trailer to the Cannon County Sheriff’s Department. The tongues had been there for 20 years. They were valued at $1,200.

The sheriff’s department had also received a report of the theft of items from a residence on Duncan Lane on Feb. 18. The homeowner reported 100 pounds of heavy metal plates, a scissor lip adapter for a hay spear and 20 tractor weights were missing.

 During the investigation of the two incidents, Nickey Fricks’ son, Cody, was developed as a suspect.

Sheriff’s Deputy Steve McMillen spoke with Cody Fricks at his residence on March 23.

Cody admitted to taking both his father’s tongues and the items from theDuncan Lane residence. He said he took the items to sell for scrap so that he could make his truck payment. 

In other cases Tuesday:

• Cory Wade Foster pled guilty to attempted failure to appear. He was sentenced to 11 months, 29 days in jail. That sentence was partially suspended upon serving 76 days, 8 months, 29 days on probation and paying the costs. In another case Foster pled guilty to theft under $500. He was sentenced to 11 months, 29 days in jail. That sentence was partially suspended upon serving 76 days in jail, 8 months 29 days on probation and paying the costs.

• Patrick Dewayne Clark pled guilty to domestic assault. He was sentenced to 11 months, 29 days in jail. That sentence was suspended upon equal time on probation, paying $600 in restitution and court costs. Clark also agreed to a revocation of probation. His probation was extended for 11 months, 29 days.

• Terry Stembridge charge of assault was retired for 9 months. He was ordered to pay the litigation tax.

• William Kevin Bryant’s charge of aggravated domestic assault was nollied after the victim did not respond to a supeona to appear.

• Earl H. Dixon pled guilty to driving without a license. He was sentenced to 30 days in jail. That sentence was suspended upon equal time on probation, paying a $2.00 fine and the costs.

• Justin Blake Kelly pled guilty to driving on a suspended license. He was sentenced to 11 months, 29 days in jail. That sentence was suspended upon equal time on probation, losing his license for one year, paying a $50 fine and the costs.

• Floyd David Kirby agreed to the revocation of probation. He was ordered to serve 45 days and his probation was extended 12 months 27 days.

• Kimberly Ann McCullum’s charge of allowing an unlicensed driver to drive was retired for 6 months. She was ordered to pay the costs.

• Trinity Shane Ruth’s charge of leaving the scene of an accident was retired for 60 days.

• William Kelly Spradley pled guilty to driving without a license. He was sentenced to 30 days in jail. That sentence was suspended upon paying a $2.00 fine and the costs.

• Clifford Brothers agreed to the revocation of probation. He was ordered to serve 6 months in jail.

• A Capias was issued for Isaiah Dennis Burton for failure to appear.

• A Show Cause was issued for Gretchen L. Hall for failure to pay court costs.
