Three Facing Charges Of DUI



Shantel C. Neel, 5416 Gassaway Rd., Woodbury, was charged with DUI and Driving While License Suspended on April 28 by Cannon County Sheriff’s Deputy Eric Moss following a traffic accident on Doolittle Rd.

Deputy Moss was dispatched to the wreck at approximately 9:40 p.m. on that date. Upon arrival he observed a gray Mercedes upside down on the side of the road. The deputy looked in and around the vehicle as well as up and down the road to insure the no one had been ejected. After being unable to locate anyone, he contacted a wrecker.

While working the accident, Deputy Moss was informed by Dispatch that someone had arrived at Stones River Hospital with injuries indicative of a person who had been in an accident. He requested a Woodbury Police officer go to the hospital to insure that the suspected victim did not leave there before he could arrive.

After clearing the accident scene, Deputy Moss went to the hospital and made contact with Neel, who stated she was the driver of the Mercedes involved in the accident.

Neel said she had been at a friend’s house drinking and was on her way home when she wrecked. She said she left the vehicle and returned to her friend’s house where her sister picked her up and took her to the hospital.

Neel appeared to be intoxicated, the deputy’s report states. Her driver’s license was also suspended. The deputy left her at the hospital so that she could be treated for her injuries.

On May 3 at approximately 6:40 p.m., Woodbury Patrolman John Fesmire stopped Neel on Gassaway Rd. and brought her to the sheriff’s department where she was served with the warrants for DUI and DWLS and with a VOP warrant out of Rutherford County and two Orders of Protection.

Bond was set at $2,000. Initial court date is June 5.

• Justin Blake Marshall, 1505 E. Depot St., Lot 12, Shelbyville, was charged with DUI and Violation of the Financial Responsibility Law on May 3 by Cannon County Sheriff’s Deputy M.J. Parsley.

The deputy responded to the area of John Bragg Hwy. and Hoover Mill Rd. on that date in reference to a motorist assist. Upon arrival he discovered that the vehicle in question was involved in a motor vehicle crash.

Deputy Parsley spoke with the operator, Marshall, who said he had been drinking and had run off the road.

Marshall had slurred speech, was unsteady on his feet and had an odor of an intoxicant. He performed poorly on field sobriety tests. He consented to blood content testing. A passenger in the vehicle, James Delffs, was wanted in Bedford County. Woodbury Auto Express towed the vehicle from the scene.

 Marshall’s bond was set at $2,500. Initial court date is June 5.

• Abdul Alataby, 2527 Sugar Tree Knob Rd., Liberty, was charged with DUI and Violation of the Implied Consent Law on April 28 by Woodbury Police Patrolman John House.

Officer House observed Alataby driving a 1993 Lexus and suspected his driver’s license might still be suspended. He turned around and followed the vehicle and observed it turn onto Highway 53N, where it crossed the fog line and ran off and then back on to the roadway. He stopped the vehicle in the vicinity of 226 Gassaway Rd.

As he approached the vehicle Officer House observed a 12-pack of beer in the front floorboard which appeared unopened. He could smell an odor of alcohol coming from inside the vehicle.

The driver, Alataby, appeared to be impaired so he was asked to exit the vehicle to determine if he was OK to drive. Based upon his driving and his performance on field sobriety tests, Alataby was charged with DUI. He refused to sign a consent form to have blood content testing performed.

Bond was set at $2,000. Initial court date is June 12.
