Shot fired, charges filed

Cannon County Sheriff's Office

Shot Fired

Jeffrey Boyce of Rogers Road was charged with reckless endangerment, aggravated assault and unlawful carry of a weapon following an incident at his neighbor's home.

Two individuals, identified as Tim Morris and Ricky Livingston, were at the neighbor's home to recover a trailer for which they had a title in hand. Deputies Turney and Moore were present.

The trailer was loaded with wood and when Morris and Livingston began unloading it, a shot rang out from an adjoining trailer. Officers moved in and ordered Boyce to the ground.

Boyce said he did not see the officers and that he had fired a round into the ground to "get their attention," meaning the men unloading the wood.

"He also stated that he did not see officers present, however, it would be evident that we were present had he paid attention to his surroundings," the deputies reported.

The shotgun used to fire the round as a tactical unit with a short 18.5 inch barrel and a high capacity magazine containing .000 buckshot and slugs.

"It was advised that there was no threat for his life and it was not legal to discharge the weapon with them nearby in an attempt to scare them," the officers said.

A hearing is set for May 2 in General Sessions Court.
