NOTICE OF FORECLOSURE SALE
WHEREAS, MARVIN C. SMITH, by Deed of Trust (the "Deed of Trust") dated November 6, 2006, of record in Record Book 92, Page 33, Register's Office for Cannon County, Tennessee, conveyed to CLAUS THORMAEHLEN, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to FIRST NATIONAL BANK;
WHEREAS, said CLAUS THORMAEHLEN, Trustee, is unable to act as Trustee under the Deed of Trust, and I, JOSHUA T. CRAIN have been appointed Successor Trustee by the owner and holder of the Note by an instrument of record in Record Book 159, Pages 568-569, Register's Office for Cannon County, Tennessee;
WHEREAS, default has been made in the payment of the Note; and
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that I, JOSHUA T. CRAIN, Successor Trustee, pursuant to the power, duty and authority vested in and conferred upon me, by the Deed of Trust, will on June 12, 2015, at 10:00 a.m. on the front steps of the Cannon County Courthouse in Woodbury, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable, and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Cannon County, Tennessee, described as follows:
Located, lying and being in the Sixth (6th) Civil District of Cannon County, Tennessee and being more particularly described as follows to wit:
A house and lot in the Town of Woodbury, being Lot #7 of the Powell Subdivision according to the Plat thereof recorded in Plat Book 1, Page 37 of the Register's Office for Cannon County, Tennessee and being a lot fronting 50 feet on Powell Street in a Northerly direction a distance of 150 feet between parallel lines.
For source of title to said realty, reference is hereby made to a certain Warranty Deed from Paul E. Gilley and wife Betty C. Gilley to Marvin C. Smith dated October 13, 1998 and recorded on October 13, 1998 in Record Book 178, Page 438, Register's Office, Cannon County, Tennessee.
This property is subject to any and all lawful easements, setback lines, restrictions, etc. of record and applying to the within described property and to the zoning regulations of the appropriate governmental body.
Being the same property conveyed to Marvin C. Smith by deed of record in Record Book 178, Page 438, Register's Office of Cannon County, Tennessee.
The address of the above-described property is Lot 7 of the Powell Subdivision, 322 Powell Street, Cannon County, Tennessee.
Said sale shall be held subject to the following:
1. County property taxes for 2014 are due and payable in the amount of $118.00 + penalty and interest for a total of $204.00.
2. City property taxes for 2014 are due and payable in the amount of $83.00 + penalty and interest for a total of $85.00
