FORECLOSURE SALE
Default having been made by failure to comply with the terms and conditions of a certain Deed of Trust dated June 13, 1997, executed by Kenneth Marx, Jr. and wife, Charlotte Marx, recorded in T.D. Book 136, Page 355, Register's Office for Cannon County, Tennessee, and wherein the said Kenneth Marx, Jr. and wife, Charlotte Marx conveyed the property therein described to Bankers Title Company, Jr., Trustee, to secure the indebtedness therein described, and the entire indebtedness having been declared due and payable as provided in said Deed of Trust and note, and payment not having been made as demanded; and the undersigned, Joel E. Jordan, of 3326 Aspen Grove Drive #604, Franklin, Tennessee 37067, having been appointed as Substitute Trustee in the place and stead of Bankers Title Company, Jr., Trustee, said appointment being set forth in the Register's Office for Cannon County, Tennessee, notice is hereby given that I, Joel E. Jordan, Substitute Trustee, having been requested so to do by the lawful owner of said indebtedness, will on Friday, January 3, 2014, at 1:00 p.m. at the Front door of the Cannon County Courthouse, Woodbury, Tennessee, sell at public outcry to the highest and best bidder for cash, free from equity of redemption, homestead and dower, and all other exemptions of every kind, all of which are expressly waived in said Deed of Trust, the following described real estate in Cannon County, Tennessee:
Lying and being in the 5th Civil District of Cannon County, Tennessee, and being more particularly described as follows:
Beginning on an iron pin in the West margin of Tennessee State Highway No. 53, this point being Edwin and Rosemary Abraham's Northeast corner therein (Deed Book 166, Page 361, Map 59, Parcel 97.02); running thence about West with the Abraham boundary line approximately 210 feet to an iron pin; running thence about South with the Williams'' boundary line approximately 308 feet to an iron pin; running thence about East on a line severing the Paull realty approximately 246 feet to an iron pin in the West margin of Tennessee State Highway 53; and, running thence about North with said Highway margin approximately 259 feet to the point of beginning, containing one and one-half (1-1/2) acres, more or less, by estimation. Being the same property conveyed to Kenneth A. Marx, Jr. by Warranty Deed from Elmus Maxie Paull, an unmarried person, dated June 13, 1997 and recorded in Book 175, Page 66, Register's Office of Cannon County, Tennessee.
Also being the same property conveyed to Olive C. Marx by Final Decree from Kenneth A. Marx, Jr. dated November 8, 2010 and recorded in Record Book 147, Page 107, Register's Office of Cannon County, Tennessee.
Included in this conveyance is a mobile home, Serial #AL-S-02344.
This is improved property known as 5474 Jim Cummings Hwy., Woodbury, Tennessee 37190.
The 2013 taxes are currently due and payable. The 2012 taxes are currently past due and delinquent.
Said sale is subject to any and all unpaid taxes and any other prior claims, liens, easements, set back lines and restrictions.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above. The Trustee/Substitute Trustee reserves the right to rescind the sale.
