Estes Charged With Breaking Into Cousin's Home

Jimmy L. Estes, 533 R. Arnold Rd., Smithville, was charged with aggravated criminal trespass and aggravated burglary on May 17 by Cannon County Sheriff’s Deputy Steve McMillen. It is alleged that Estes feloniously entered the habitation of Terry Wayne Sanders without Sanders’ consent.

Deputy McMillen and Sgt. Randy Neal responded to 6510 Short Mountain Hwy. for a report of a break-in that had already occurred. On arrival Deputy McMillen spoke with Sanders, who stated he left his residence around 5 p.m. and returned around 8:30 p.m. and when he went to open his back door he saw where it had been pride open, but had been locked back.

Sanders advised he looked to see if anything had been taken, but found nothing missing at that time. He said his shotgun had been taken out of the cabinet and was leaning against the dresser. There was damage done to the bedroom door facing that was estimated at $300.

Sanders stated he had given his cousin, Jimmy Lane Estes, a ride to Alan Young’s house on Dunlap Lane earlier that day and that he suspected Estes of breaking into his residence.

After taking the report, Deputy McMillen and Sgt. Neal went to 160 Dunlap Lane to speak with Young. While standing at the door, Deputy McMillen observed a white male sitting on the couch as if he was asleep. After knocking several times, Young came to the door.

Sgt. Neal asked Young who the person on the couch was and he said it was Jimmy Estes. Sgt. Neal asked Young if Estes had been to Terry Sanders’ house earlier and Young said yes, that he had taken him there so he could visit his mother. Young went on to say that when they arrived, they did not see any vehicles at the residence.

Young said that Estes went to the back door and was gone for about 15-20 minutes. Young said he got tired of waiting and started blowing the horn. Young said Estes came back to the truck and asked if he needed a shotgun and Young told him no. Young stated Estes was gone long enough to go through the house, but did not know if he had taken anything from the residence.

Young also stated he did not know if Estes broke into the house, but did know that Sanders was not home at the time they were there.

At this point Deputy McMillen placed Estes under arrest. He was taken to the Cannon County Jail and read his Miranda rights. Estes refused to give a statement.

Bond was set at $17,000. Initial court date is June 14.
