NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated February 27, 2004, and the Deed of Trust of even date securing the same, recorded March 2, 2004, at Book 55, Page 174 in Office of the Register of Deeds for Cannon County, Tennessee, executed by DAVID R. BURGESS, JR. AND ALYSON BURGESS, conveying certain property therein described to David R. Wilson, Williamson County as Trustee for Chase Manhattan Mortgage Corporation; and the undersigned, Shellie Wallace of Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.

TRUSTEE’S NOTICE OF SALE
Default having been made in the payment of the debts and obligations secured to be paid by a certain deed of trust executed by Kenneth Streeval and wife, Tina A. Streeval, on the 1st day of February, 2007, to Robert L. Miller, Trustee, as same appears of record in the Register’s Office of Cannon County, Tennessee, in Record Book 95, page 119, and Citizens Bank being the owner and holder of the debt secured, having requested the undersigned to advertise and sell the property described in and conveyed by the said deed of trust, all of the said indebtedness having matured by default in the payment of a part thereof, this is to give notice that the undersigned will on January 15, 2010, commencing at 11:30 a.m., at the north door of the Cannon County Courthouse, Woodbury, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described tract of property, lying and being in the 5th Civil District of Cannon County, to-wit:

Said sale shall be subject to any unpaid property taxes, to any additional prior, liens, leases, encumbrances, to any rights of redemption not heretofore expressly waived, and to all applicable reservation of minerals, easements, rights-of-way, setback lines and restrictions.
The equity of redemption, statutory right of redemption, homestead, dower, elective share and all other rights and exemptions of every kind are waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only such title as he may convey as Trustee there being no representations or covenants of warranty of title made hereby.
It will be the responsibility of the successful bidder to obtain possession of the property at his expense, and any damage, vandalism, theft, destruction, or other loss or damage to the property occurring subsequent to the date of sale shall be at the risk of the successful bidder.
The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by the Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee.

FORECLOSURE SALE NOTICE
WHEREAS, Caffey Construction, LLC by Jack S. Caffey, by a Deed of Trust, dated April 4, 2008, of record in Record Book 109, Page 118 and a Modification dated April 13, 2009 of record in Record Book 118, page 245, Register’s Office for Cannon County, Tennessee, conveyed to Randall Clemons, Trustee, the hereinafter described real property to secure payment of a promissory note as described in said Deed of Trust; and
WHEREAS, Robert Evans Lee having been appointed Substitute Trustee by Wilson Bank & Trust, the owner and holder of said note by an instrument of record in Record Book 122, Page 578, Register’s Office for Cannon County, Tennessee, with authority to act alone with the powers given the Trustee; and

Tuesday, January 19th, at 6:00 pm
at the Woodbury City Hall concerning a revision to the “Subdivision Regulations” regarding Developers to install street lighting within new subdivisions. The amendment can be reviewed at City Hall.

NOTICE OF PUBLIC HEARINGS

The Woodbury Mayor and Aldermen will hold a Public Hearing on Tuesday, January 5th, 2010, 7:00 P.M. at the Woodbury City Hall concerning the following proposed ordinances:

Ordinance No. 428-an ordinance to rezone Smith Funeral Home from R-1 (Residential) to C-3 (Highway Commercial). The proeprty is located at 303 Murfreesboro Road (Map 039P, Group A, Parcel 016.00 Approx. 1.5 acres). The request is being made by the property owner William B. Smith. The ordinance and map will be posted at the Woodbury City Hall for public review.

Ordinance No. 429 - an ordinance amending Section 18-320 of the Woodbury Municipal Code, to incude a revised cross-connection policy.

These proposed BFEs are the basis for the floodplain management measures that your community is required to either adopt or show evidence of having in effect in order to qualify or remain qualified for participation in the National Flood Insurance Program (NFIP).
