NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated April 12, 2004, and the Deed of Trust of even date securing the same, recorded April 23, 2004, at Book 57, Page 184 in Office of the Register of Deeds for Cannon County, Tennessee, executed by Michelle Nichols and Rodney Nichols, conveying certain property therein described to W. Aaron Fortner as Trustee for Mortgage Electronic Registration Systems, Inc., acting solely as Nominee for Churchill Mortgage Corporation and Churchill Mortgage Corporation’s Successors and Assigns; and the undersigned, Shellie Wallace of Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Shellie Wallace of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on January 14, 2011 on or about 3:30 P.M., at the Cannon County Courthouse, Woodbury, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Cannon County, Tennessee, and being more particularly described as follows:
Beginning on an iron pin in the north margin of the Blues Hill Public Road, this point being Graham Osment’s Southwest corner therein; running thence about northeast with Graham Osment’s boundary line 210 feet to an iron pin there in; running thence about south or southwest on a line approximately parcel to Graham Osment’s boundary line about 210 feet to an iron pin in the north margin of Blues Hill Public road; and running thence about southeast with said road margin 210 feet to the point of beginning, containing one acre, more or less.  For Identification purposes only, this realty is a portion of map number 42, parcel number 43, Office of the County Tax Assessor.

SUBSTITUTE TRUSTEE’S SALE
Default having been made in the terms, conditions, provisions and payments made and provided for in a deed of trust dated September 6, 2007, executed by Robert S. Slatton, Jr. and Jamie Slatton, to Investors Title Company, as Trustee, and recorded in Book 103, Page 11, of record in the Register’s Office for Cannon County, Tennessee, to secure the indebtedness therein described, and the entire indebtedness having been called due and payable as provided in said deed of trust, and said payment not having been made, and the lawful owner and holder of said indebtedness having appointed the undersigned, David G. The Substitute Trustee may adjourn or postpone the aforementioned sale of real property by public announcement at such time and place of sale, and from time to time thereafter may postpone such sale by public announcement at the time and place fixed by the preceding postponement or subsequently noticed sale, and without further notice make such sale at the time fixed by the last postponement, or may, in its discretion, give a new notice of sale.  If applicable, the Notice requirements of T.C.A. § 35-5-117 have been met.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and, if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof.  The proceeds derived from the sale of the property will be applied as provided for in said deed of trust.

The Town of Woodbury Board of Mayor and Aldermen will hold a Public Hearing Tuesday, January 4, 2011 at 7:00 PM at Woodbury City Hall concerning the following two proposed Ordinances:

Ordinance No. 436--an ordinance to amend Ordinance No. 421 (regulatiing the sale, distribution for sale, and manufacturing of beer with the Town of Woodbury), by amending Section 8-210 to allow restaurants located on the public square to sell beer.

Ordinance No. 437--an ordinance to amend Ordinance No. 421 (regulatiing the sale, distribution for sale, and manufacturing of beer with the Town of Woodbury), by amending Section 8-212(2).
