TRUSTEE’S SALE
WHEREAS, on the 15th day of November, 2002,  by deed of trust of record in the Register’s Office of  Cannon County, Tennessee in Record Book 35, Page 451, RANDY MAHAFFA and wife, BRENDA MAHAFFA,  conveyed to Randall Clemons, Trustee, the hereinafter described real estate to secure payment of a promissory note which is fully described in said deed of trust; and,

Watershed Description: The watershed is the Brawley’s Fork watershed (051302030102). The Carson Fork segment identification is TN05130203027_1000. The stream segment was last assessed on 03/13/2003 for the following designated uses: fish and aquatic life - assessed as supporting; livestock watering and wildlife - supporting; recreation - supporting; and irrigation - supporting.

Project Description: The applicant proposes to dredge gravel from a point bar at the above location. The anticipated excavation exceeds 50 cubic yards. The gravel is to be used locally on gravel driveways and farm roads, but is not sold commercially. The applicant proposes to excavate gravel on an as needed basis following gravel dredging guidelines (no excavation below the water line and leave a berm of 10 feet). This site was formerly permitted to the applicant under permit # NR0507.119.

Determinations: In accordance with the Tennessee Antidegradation Statement (Rule 1200-4-3-.06), the division has determined that dredging in excess of fifty cubic yards of bed-load gravel will result in more than an insignificant lowering of water quality.

How to Comment: No decision has been made whether to issue or deny this permit. The purpose of this notice is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impacts to water quality. Persons wishing to comment on the proposal are invited to submit written comments to the department. Written comments must be received within thirty days of the date that this notice is posted. Comments would become part of the record and would be considered in the final decision. The applicant’s name and permit number should be referenced.

Hearings: Interested persons may also request in writing, within the comment period, that the department hold a public hearing on this application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient public interest in water quality issues, the department would hold a public hearing.

Factors Considered: In deciding whether to issue or deny a permit, the department would consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination would be made regarding the lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Town of Woodbury.

REQUEST FOR RELEASE OF FUNDS
On or about December 31, 2010 the Town of Woodbury will submit a request to the Department of Economic and Community Development for the release of Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the FY 2010 Town of Woodbury CDBG Water System Rehabilitation Project, for the purpose of rehabilitating portions of the Woodbury Water System.  The project funding is estimated to be $575,000 with $500,000 coming from CDBG funding.  The project location is in the Woodbury Water System Service Area, Cannon County, Tennessee.

FINDING OF NO SIGNIFICANT IMPACT
The Town of Woodbury has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the Office of the Mayor, Town of Woodbury, 101 W. Water St., Woodbury, TN and may be examined or copied weekdays 8:00 a.m. to 4:00 p.m.

PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Mayor Harold Patrick, 101 W. Water St., Woodbury, TN  37190.  All comments received by December 29, 2010 will be considered by the Town of Woodbury prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The Town of Woodbury certifies to the Tennessee Department of Economic and Community Development that Harold Patrick in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  The Tennessee Department of Economic and Community Development (ECD) approval of the certification satisfies its responsibilities under NEPA and related laws and authorities.

OBJECTIONS TO RELEASE OF FUNDS
The Tennessee Department of Economic and Community Development will accept objections to its release of funds and the Town of Woodbury certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis:
(a)    The certification was not executed by the Certifying Officer of the Town of Woodbury;
(b)    The Town of Woodbury has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58;
(c)    The grant recipient has committed funds or incurred costs not authorized by 24CFR Part 58 before approval of a release of funds by the Tennessee Department of Economic and Community Development; or
(d)    Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
