Notice is hereby given that on the 16th day of November, 2010, letters testamentary in respect to the estate of Rachel D. Haley, deceased, were issued to the undersigned by the County Probate Court of Cannon County, Tennessee. TRUSTEE’S SALE
WHEREAS, on the 15th day of November, 2002,  by deed of trust of record in the Register’s Office of  Cannon County, Tennessee in Record Book 35, Page 451, RANDY MAHAFFA and wife, BRENDA MAHAFFA,  conveyed to Randall Clemons, Trustee, the hereinafter described real estate to secure payment of a promissory note which is fully described in said deed of trust; and,

Northcutt, Trustee, having been appointed as Successor Trustee by instrument of record dated and filed on in Record Book 129, Page 513, said Register’s Office, pursuant to the power, duty, and authority vested in and imposed upon me in the Deed of Trust, having been requested so to do by the lawful owner of said indebtedness, will on Tuesday, December 14, 2010 at 1:00 P.M.  at the front entrance of the Courthouse in Woodbury, Cannon County, Tennessee, sell at public outcry to the highest and best bidder for cash, free from the equity of redemption, homestead and dower, and all other exemptions of every kind, all of which are expressly waived in said deed of trust, the following described real estate in Cannon County, Tennessee, together with any and all improvements, tenements, hereditaments and appurtenances, all easements serving or benefiting the property, and any or all fixtures and improvements now or hereafter attached to the property (collectively, the “Property”):
SITUATED, lying and being in the Sixth (6th) Civil District of Cannon County, Tennessee fronting 318 feet along the West side of what is known as South College Street of the town of Woodbury the Northeast corner of the lot hereby conveyed being the Southeast corner of the Woodbury Housing Authority lands as described in deed from I. F. Bailey, et us to Woodbury Housing Authority dated May 26, 1972,l and recorded in the Register’s Office of said County in Deed Book 88, Page 176, and more particularly described as follows:
BEGINNING at a point in the West margin of said Street 318 feet South of said Woodbury Housing Authority corner and running thence in a Northerly direction along the West margin of said street a distance of of 318 feet to said Woodbury Housing Authority corner; thence in a westerly direction a distance of 412 feet with the South line of said Woodbury Housing Authority lands to a stake; thence in a Southerly direction on a line parallel with said street and the East side of the lot hereby conveyed a distance of 318 feet to a stake; thence in an easterly direction on a line parallel with the North line of the lot hereby conveyed a distance of 412 feet, to the point of beginning.
Being the same property conveyed to AMJ TOOLING SOLUTIONS, LLC  by deed of record in Record Book 102, Page 101, Register’s Office for Cannon County, Tennessee.
The street address of the Property is believed to be: 800 College St., Woodbury, TN 37190, but such address is not part of the legal description of the Property.  In the event of any discrepancy, the legal description herein shall control.
Said sale is or may be subject to any and all unpaid taxes plus penalty and interest, if any; defects, encumbrances, adverse claims and any other matters which take priority over the deed of trust, including rights of redemption of any governmental agency, state or federal, which have not been waived by such governmental agency; statutory redemption rights,  liens, easements, plan of record, set back lines, restrictions, and any other prior claims including, but not limited to, a first mortgage deed of trust to  of record in Book , Page , said Register’s Office.
This property is to be sold AS IS WHERE IS without representations or warranties of any kind whatsoever, whether express or implied.  Without limiting the foregoing, THE PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE.
The right is reserved to adjourn the date of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above.  If the highest bidder cannot pay the bid within twenty-four (24) hours of the sale, the next highest bidder, at their successful bid, shall be deemed the successful bidder.
