NOTICE OF SUBSTITUTE TRUSTEE`S SALE
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated July 15, 2004, executed by AUGUST WAYNE PENDERGRASS AND MICHELLE L. PENDERGRASS, August Wayne Pendergrass, conveying certain real property therein described to Robert M. Wilson, Jr., as Trustee, as same appears of record in the Register’s Office of Cannon County, Tennessee recorded on July 22, 2004 at Book/Instrument No. 61, Page 445-452; and
WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to BAC Home Loans Servicing, LP f/k/a Countrywide Home Loans Servicing LP who is now the owner of said debt; and
WHEREAS, the undersigned, Everett L. Hixson, Jr., having been appointed by as Substitute Trustee by instrument to be filed for record in the Register’s Office of Cannon County, Tennessee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Everett L. Hixson, Jr., as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee will, on August 6, 2009 at 02:00 PM at the CANNON County Courthouse door where the foreclosure sales are customarily held at the CANNON Courthouse, located in Woodbury, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Cannon County, Tennessee, to wit:
Being all of lot No. 6 of Indian Springs, Phase V, according to survey and plat of same appearing of record in plat cabinet 2, slide 2-38b, Register`s Office of Cannon County, Tennessee, to which plat reference is hereby made for a more complete description.
Being the same property conveyed to August Wayne Pendergrass and wife, Michelle L. Pendergrass, by Deed of Record in Book 61, page 443, said Register`s Office.
The conveyance is subject to all easements, restrictive covenants and conditions, and matter of record, including all items set out on any applicable plat of record.
PROPERTY ADDRESS: The street address of the property is believed to be 165 Gilley Hill Road, Bradyville, TN 37026.
In the event of any discrepancy between this street address and the legal description of the property, the legal description shall control.
CURRENT OWNER(S): August Wayne Pendergrass, Michelle L. Pendergrass
OTHER INTERESTED PARTIES: Ascend Federal Credit Union, Beneficial Tennessee Inc.
The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. This property is being sold with the express reservation that it is subject to confirmation by the lender or Substitute Trustee. This sale may be rescinded at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The Property is sold as is, where is, without representations or warranties of any kind, including fitness for a particular us or purpose.

NOTICE OF PUBLIC HEARINGS
The Town of Woodbury Board of Mayor and Aldermen will hold public hearings concerning each of the following proposed ordinances on Tuesday, August 4, 2009 at 7:00 P.M. at Woodbury City Hall, 101 West Water Street.

Ordinance No. 425 - An ordinance to annex approximately .53 acres +/- of property in the Forrest Park subdivision on Tanglewood Drive (Map 046F, Group A, Parcel 027.00) in accordance with Tennessee Code Annotated. The property is owned by Jimmy and Toni Lester and is proposed to be a designated zone of R-1 (low density residential). The map and ordinance will be posted at the Woodbury City Hall, the Woodbury Post Office, and the Cannon County Courthouse for public review.

Ordinance No. 426 - An ordinance to zone annexed property of approximately .53 acres +/- in the Forrest Park subdivision on Tanglewood Drive (Map 046F, Group A, Parcel 027.00) to an R-1 (Low Density Residential) zone. The property is owned by Jimmy and Toni Lester. The map and ordinance will be posted at the Woodbury City Hall, the Woodbury Post Office, and the Cannon County Courthouse for public review.

Resolution 5-09 - A resolution adopting a Plan of Services for the annexation of approximately .53 acres +/- in the Forrest Park subdivision on Tanglewood Drive (Map 046F, Group A, Parcel 027.00). A copy of the map and the plan of services will be posted at the Woodbury City Hall, the Woodbury Post Office, and the Cannon County Courthouse for public review.

Ordinance No. 427 - An ordinance amending the Woodbury Beer Ordinance, in order that the distance from beer establishments to places of public gathering that do not have buildings may also be considered.
