NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 5, 2003, and the Deed of Trust of even date securing the same, recorded September 15, 2003, at Book 48, Page 601 in Office of the Register of Deeds for Cannon County, Tennessee, executed by Leland K. Mankin and Dorinda Bolden Mankin, conveying certain property therein described to Title Enterrprise, Inc. as Trustee for Mortgage Company of America; and the undersigned, Shellie Wallace of Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Shellie Wallace of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on July 2, 2010 on or about 3:30 P.M., at the Cannon County Courthouse, Woodbury, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR CASH, free from the statutory right of redemption, homestead, dower, and all other exemptions which are expressly waived in the Deed of Trust, said property being real estate situated in Cannon County, Tennessee, and being more particularly described as follows:

Beginning at a metal pin set at fence corner on the west margin of McMinnville Hwy. at the northeast corner of the Mullican property D.B. 180, page 29 same being the southeast corner of the herein described property; thence leaving said margin of road south 89 degrees 22 minutes 01 sec. west 381.09 feet to a metal pin set a fence corner; thence south 18 degrees 32 minutes 09 seconds west 89.53 feet to a metal pin set at fence post in fence; thence south 26 degrees 31 minutes 16 seconds west 353.35 feet to a metal pin set at fence corner post at the southernmost tip of the herein described property; thence north 37 degrees 39 minutes 33 seconds west 596.84 feet to a metal pin set at fence corner; thence north 82 degrees 50 minutes 51 seconds west 133.46 feet to a metal pin set at fence post break; thence north 68 degrees 34 minutes 26 seconds west 19.49 feet to a 10 inch hickory tree in fence; thence north 17 degrees 44 minutes 42 seconds west 145.60 feet to a 20 inch maple in fence; thence north 09 degrees 50 minutes 08 seconds west 55.26 feet to a metal pin set at snag end of fence and centerline of a creek; thence north 73 degrees 19 minutes 31 seconds east 546.93 feet to a metal pin set in fence post; thence north 50 degrees 08 minutes 37 seconds east 193.33 feet to a metal pin set a fence post; thence north 87 degrees 37 minutes 54 seconds east 154.07 feet to a metal pin set at fence corner post on the west margin of said Highway; thence with said Highway south 28 degrees 29 minutes 24 seconds east 650.01 feet to the point of beginning, containing 11.99 acres, according to survey conducted by Northcutt Surveying, Inc. 117 Hickory Drive, Shelbyville, Tennessee 37160 on April 19,2000.

This conveyance is subject to right of way easement of record in deed book 146, page 61, Register’s Office for Cannon County.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Notice is hereby given that on the 24th day of May, 2010, letters testamentary in respect of the estate of James L. Witty, deceased, were issued to the undersigned by the Chancery Court of Cannon County, Tennessee.
All persons both resident and non-residents, having claims matured and unmatured against said estate are required to file same with the clerk of the above named court within four months of the first publication of this notice, otherwise their claims will be forever barred.
