NOTICE OF SUBSTITUTE TRUSTEE’S SALE

Whereas, by Deed of Trust dated January 28, 2008, recorded in Book/Page 107/404 of the Deed of Trust Records of Cannon County, Tennessee, Tammy L. Floyd, Thomas D. Floyd and April R. Floyd conveyed to Tim Williams, as Trustee, the property situated in Cannon County, Tennessee, to wit:
A certain tract of parcel of land in the 2nd Civil Division of Cannon County, State of Tennessee, as follows:
Beginning at an iron pin, the Northeast corner of this tract, in the West margin of State Route No. 53; Thence proceeding wit the West margin of State Route 53 S 03 deg 15.4 min E 59.97 feet; S 02 deg 38.1 min W 196.32 feet; S 05 deg 55.8 min W 420.10 feet and S 07 deg 53.2 min 42.83 feet to an iron pin, the Southeast corner of this tract; thence proceeding N 80 Deg 30.8 min W 225.51 feet to an iron pin set 25 feet from center of unimproved roadway; thence proceeding with the East margin of said roadway N 07 deg 01.4 min E 160.70 feet; N 10 deg 56.4 min W 64.06 feet, N 30 deg. 29.7 min W 104.34 feet, and N 32 deg 50.9 min W 109.52 feet to a 24” poplar; and continuing along the East margin of said unimproved road N 38105.7 min W. 170.14 feet to a corner with the East margin of a gravel road; thence proceeding with gravel road East margin N 17 deg 40.9 min E 68.90 feet to an iron pin, the Northwest corner of this tract; thence N 80 deg 50 min E 472.26 feet to the beginning, containing 5 acres according to survey of Robert N. Kanter dated July 3, 1988, as well as a 2005 Champion Mobile Home, 21-05-824-12426A/B.
Being the same property conveyed to Thomas D. Floyd and Tammie L. Floyd by Deed of Record in Book 147, page 183, of the Register’s Office, Cannon County, Tennessee,
Property is commonly known as 145 Old Pumphouse Road, Woodbury, TN 37190.

WHEREAS, the undersigned is the Substitute Trustee as appointed in the aforesaid Deed of Trust by a substitution, said appointment being in the manner authorized by the Deed of Trust; and
WHEREAS, default has occurred under the terms of the Note secured by the Deed of Trust, and the indebtedness evidenced therein is now wholly due, the owner and holder of said indebtedness, 21st Mortgage Corporation, has requested the undersigned Substitute Trustee to sell the Property to satisfy same.
NOW, THEREFORE, notice is hereby given that on Tuesday, March 9, 2010, the substitute trustee will sell the property to the highest bidder for cash. The Trustee’s sale will occur on or about 10:00 a.m. at the front door of the Cannon County Courthouse, 1 Courthouse, Woodbury, TN 37190.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter than an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property: Tammy L. Floyd, Thomas D. Floyd and April R. Floyd.

SUBSTITUTE TRUSTEE’S SALE
WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust executed on April 30, 2007, by David Myers and Mildred Myers to Wesley D. Turner, Trustee, as same appears of record in the Register’s Office of Cannon County, Tennessee, under Book 98, Page 274, (“Deed of Trust”); and WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to Citibank, N.A., as trustee for WAMU Series 2007-HE4 Trust; and WHEREAS, Citibank, N.A., as trustee for WAMU Series 2007-HE4 Trust, the current owner and holder of said Deed of Trust, (the “Owner and Holder”), appointed the undersigned, Nationwide Trustee Services, Inc., as Substitute Trustee by instrument filed for record in the Register’s Office of Cannon County, Tennessee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Owner and Holder, and that the undersigned, Nationwide Trustee Services, Inc., Substitute Trustee, or his duly appointed attorneys or agents, by virtue of the power and authority vested in him, will on Thursday, March 18, 2010, commencing at 12:00 PM at the Main Entrance of the Cannon County Courthouse, Woodbury, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Cannon County, Tennessee, to wit: Exhibit “A” A house and lot located in the 6th Civil District of Cannon County, Tennessee at 106 West Adams Street in the Town of Woodbury in the Forrest Park Subdivision (Section #1), the plat of which is recorded in Plat Book 1, Page 43,in the register’s office for said county. Said lot has a frontage of ninety (90) feet on West Adams Street, a back line of fifty-two (52) feet; an East boundary line of about one hundred eighty-nine and one-half (189-1/2) feet; and a West boundary line of about one hundred eighty-five and one-half (185-1/2) feet. Being the same property conveyed to David K. Myers and wife, Mildred L. Myers, by deed from Leo Parker and wife, Juanita Parker and Dorris and wife, Carole Davenport, dated and recorded January 5, 2001, in Record Book 8, Page 500, Register’s Office for Cannon County, Tennessee. PROPERTY ADDRESS: 106 West Adams Street, Woodbury, TN 37190 CURRENT OWNER(S): David Myers and Mildred Myers The sale of the above-described property shall be subject to all matters shown on any recorded plan; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose. NOTICE OF MEETING
Cannon County 9-1-1 Board of Directors

The Board of Directors of the Cannon County 9-1-1 Emergency Communications District will meet at 6:30 p.m. April 13 in the Conference Room of the Stones River Hospital in Woodbury, Tennessee, or such other location as may be posted at the Courthouse, where and which time the Board will consider any matter that may be properly presented. Meetings of the Board are at the same time and location on the 2nd Tuesday of the months of February, April, June, August, October, and December. A public hearing is held at the June meeting for the purpose of reviewing the budget proposed for the fiscal year that begins July 1.
The public is invited to all meetings.

2008 DELINQUENT TAX NOTICE
67-2002, Delivery of Delinquent lists to attorney. After the publication of the aforesaid notice, the Trustee shall deliver the delinquent lists showing all unpaid land taxes to an attorney.

Unpaid 2008 taxes not paid by March 2010 will be published in the Cannon Courier.
