Five Bind Cases Over To Grand Jury

Five persons had the cases against them bound over to the January term of the Cannon County Grand Jury in General Sessions Court Tuesday (Nov. 1).

Judge Susan Melton presided over the preceding, which also featured several guilty pleas entered to drug and DUI charges.

• Jason Todd Tenpenny pled guilty to one of the 14 charges he faces, and bound the remainder over to the Cannon County Grand Jury. He received 6 months in the Cannon County Jail on a charge of Theft Under $500 and was ordered to serve the entire sentence. He was given credit for time served dating back to his Sept. 4 arrest.

Bound over to the grand jury, which will meet on January 20, were charges of Manufacture of Methamphetamine, Manufacturing Marijuana, Maintaining a Dwelling, Possession of a Schedule II drug with Intent, Possession of a Schedule VI drug with Intent, Contraband in a Penal Institution, Theft Over $1,000 (five counts), Carrying a Weapon and Possession of Drug Paraphernalia.

• Julia Taylor Chambless waived a preliminary hearing and had a charge of Aggravated Domestic Assault bound over to the grand jury.

• Darris Dean Cooke waived a preliminary hearing and had DUI, Leaving the Scene of an Accident, Simple Possession, Possession of Drug Paraphernalia and violation of the Implied Consent and Financial Responsibility laws charges bound over to the grand jury.

• Benton Tyler Martin waived a preliminary hearing and had bound over to the grand jury charges of Theft Over $1,000 (two counts) and Vandalism (two counts).

• David William McPeak waived a preliminary hearing and had bound over to the grand jury charges of Theft Over $10,000, Theft Over $1,000 and Resisting Arrest.

In other cases:

• Joseph William Kendall pled guilty to DUI 3rd Offense. He received a jail sentence of 11 months, 29 days and was ordered to serve the entire sentence. He also received a fine of $1,100 and was assessed court costs. His license was also suspended for three years.

• Timmy Lee Young pled guilty to DUI 1st offense. He received a partially suspended sentence of 11 months, 29 days, equal time on probation, ordered to serve 48 hours in the county jail and pay a $350 fine. A charge of Evading Arrest with a Motor Vehicle was dismissed.

• Toby Lynn Young pled guilty to Evading Arrest by Motor Vehicle and received a suspended sentence of 11 months, 29 days, equal time on probation, and was ordered to pay court costs. He also pled guilty to Possession of Drug Paraphernalia, was given a suspended sentence of 11 months, 29 days, equal probation time and was ordered to pay court costs. He also pled guilty to Driving on a Suspended License and received a 6-month suspended sentence and equal probation time. He was also assessed court costs and his license was suspended for one year. His probation periods for evading arrest and drug possession will run consecutively.

• Maurice Lee Griffith pled guilty to Simple Possession of Marijuana and to Facilitation to Manufacture Marijuana. He received a suspended sentence of 11 months, 29 days on the possession conviction and equal time on probation. He was also ordered to pay a $1,000 fine, court costs, and will forfeit seized property. Griffith received a 6-month suspended sentence and equal probation time on the manufacture conviction, was fined $1,000, was ordered to pay court costs, and forfeit seized property. The probation periods will run consecutive.

• Melissa Joy Brown pled guilty to Violation of Probation. She was ordered to serve her original sentence of 11 months, 29 days.

• Joseph Burks pled guilty to Domestic Assault. He received a suspended sentence of 11 months, 29 days and equal time on probation. He was ordered to pay court costs, have no contact with the victim and to undergo a Domestic Violence Inventory assessment. A charge of Public Intoxication was dismissed.

• Shauna Carrick admitted to guilt and entered into an agreed order of retirement for Phone Harassment. She was ordered to pay court costs, have no contact with the victim and to contact her probation officer monthly until all conditions are met.

• Heather Ann Crawford pled guilty to Driving while License Suspended. She received a 6-month suspended sentence, 6 months probation, a $50 fine, was assessed court costs, and her license was suspended.

• Jeremy Nelson Moulder pled guilty to Disorderly Conduct, received a 30-day suspended sentence, 30-days probation and was assessed court costs.

• Belinda Robbin Perry pled guilty to Domestic Assault. She received a suspended sentence of 11 months, 29 days, equal probation time and was ordered to pay court costs, stay away from the victim and undergo a Domestic Violence Inventory assessment. A charge of Violation of Bond Conditions was dismissed subject to good and lawful conduct.

• Jacqueline Lynn Barrett pled guilty to Violation of Probation. She was sentenced to 30 days in the county jail and she will be back on probation for 4 months upon release.

• Bobby Jerome Davenport pled guilty to Driving on a Suspended License. He received 6 months probation, a $50 fine, was assessed court costs and his license was suspended.

• Roy Edward Frazier pled guilty to Driving on a Suspended License. He was ordered to serve his entire sentence, which will run concurrent with one he is serving in DeKalb Co. He was also ordered to pay court costs and his driver’s license was suspended.

• Troy Dale Gibson pled guilty to Violation of Probation. He was released on time served and placed back on probation for 11 months, 29 days.

• Deborah Lynn Green admitted to guilt and entered into an agreed order of retirement for 11 months, 29 days on a charge of Accessory After the Fact. She was also assessed court costs.

• Linda Darlene Holt admitted to guilt on the charge of Accessory After the Fact and entered into an agreed order of retirement for 11 months, 29 days. She was also ordered to pay court costs.

• Wesley Jacob Hayes admitted to guilt on the charge of Aggravated Criminal Trespass. He was given a suspended sentence of 11 months, 29 days, equal time on probation, assessed court costs and ordered to stay away from the premises where the incident occurred.

• Austin Cole Heath admitted to guilt on the charge of Underage Consumption of Alcohol and entered into an agreed order of retirement for 9 months. He was ordered to pay court costs and to contact probation services monthly until all conditions are met.

• Matthew D. Griffith pled guilty to Violation of Probation. He was placed back on probation for 10 months, 29 days and ordered to pay court costs.

• James Franklin Kilpatrick pled guilty to Public Intoxication. He received a 30-day suspended sentence, equal time on probation, a $10 fine and was assessed court costs.

• Jacob William Steele pled guilty to Driving on a Suspended License. He received a 6-month suspended sentence, equal time on probation, a $50 fine, was assessed court costs and his driver’s license was suspended.

• Michael Shane Thomas pled guilty to violation of the Financial Responsibility law. He was fined $2 and assessed court costs.

• Josh Alan Thrower pled guilty to Driving without a License. He received a 30-day suspended sentence, was fined $2 and assessed court costs.

• Teri A. Walls pled guilty to Violation of Probation. She was ordered to serve 45 days in the county jail and upon release her probation will be extended 10 months, 29 days.

• Laura Nicole Whitworth pled guilty to Domestic Assault. She received a partially suspended sentence of 6 months in the county jail and was given credit for time served. She was placed on probation for 5 months, assessed court costs, and ordered to have no contact with the victim.

Cases continued or dismissed Tuesday included:

• Justin Tyler Barrett, charged with Initiating the Manufacture of Methamphetamine, Introduction of Contraband into a Penal Institution and Accessory After the Fact was reset for Nov. 8, when he will request a bond reduction.

• Winford Nile Belcher was reset for Dec. 6 pending payment of court costs.

• Nicholas James Butcher, charged with Violation of Terms of Retirement, was dismissed after it was determined he had met all conditions.

• Randy Allen Caldwell, charged with Simple Possession of a Schedule II drug, Simple Possession of a Schedule IV drug, and Possession of Drug Paraphernalia, failed to appear. A Capias was issued for his arrest.

• Brandon James Croasmun had charges of Assault, Vandalism and Violation of an Order of Protection dismissed when the state declined prosecution.

• Jimmy Douglas Davis, Jr., charged with Theft Over $10,000, Possession of Stolen Property Over $1,000, Manufacture of Methamphetamine, Maintaining a Dwelling for Manufacturing Methamphetamine, Possession of a Schedule II drug, Simple Possession of Marijuana and Possession of Drug Paraphernalia, was reset for Dec. 6.

• Russell Allen Deese, charged with DUI, was reset for Dec. 13.

• Gregory Wayne Elliott, II, charged with Assault, Disorderly Conduct and Underage Consumption, was reset for Dec. 13.

• Cynthia Ann Ennis, charged with Delivery of a Schedule II Controlled Substance, Introduction of Contraband into a Penal Institution, was appointed an attorney and her case was reset for Dec. 13.

• Richard Wayne Erquart, charged with DUI (1st offense), was reset for Jan. 3.

• Jerry Ray Gunter, charged with Driving on a Suspended License and Violation of Probation, was reset for Jan. 24.

• Amanda Rhea Hollis, charged with Failure to Appear, was reset for Jan. 3.

• Adrian M. James, charged with Aggravated Stalking, Phone Harassment, Aggravated Trespass and Harassment, was appointed an attorney and reset for Jan. 3.

• Kalena Elizabeth Kestner, charged with Disorderly Conduct, was reset for Dec. 6.

• Daniel Ryan Matheny, charged with Simple Assault and violations of the Seatbelt and Financial Responsibility laws, was reset for Nov. 8.

• Keith Abraham McMackins, charged with Driving on a Suspended License, failed to appear. A Show Cause was issued.

• Crystal Spring McMahon, charged with Contraband in a Penal Institution and Possession with Intent to Deliver, was appointed the public defender and reset for Nov. 15.

• James Lee McPeak had a preliminary hearing set for Dec. 20 on the charges of Manufacture of Methamphetamine, Maintaining a Dwelling for Manufacture Methamphetamine, Theft Over $10,000, Theft Over $1,000 and Theft Under $500.

• George Owen Mears, charged with DUI, was appointed the public defender and reset for Dec. 6.

• Michael D. Miller had charges of Reckless Endangerment dismissed at the request of the state.

• Jason Morris Moore, charged with Possession of Methamphetamine with Intent to Resale, Carrying A Weapon, Driving on a Suspended License and Possession of Drug Paraphernalia, was reset for Nov. 15.

• Jessica Ramey was appointed the public defender to represent her on charges of Introduction of Contraband into a Penal Institution and Delivery of a Schedule II Controlled Substance. The case was reset for Dec. 13.

• Stanley O. Reeves was appointed an attorney to represent him on a charge of Public Intoxication and the case was reset for Dec. 13.

• Daryk William Rublee, charged with Reckless Driving, was reset for Dec. 6.

• Timothy Gordon Shafer, charged with Driving on a Revoked License and Fugitive from Justice, failed to appear. A Capias was issued for his arrest.

• Jerry Lynn Sissom had reset for Feb. 7 charges of Domestic Violence, Reckless Endangerment, Aggravated Assault with a Deadly Weapon (two counts), Carrying a Weapon with the Intent to Go Armed and Disorderly Conduct.

• Leroy Carter Stingley, Jr., charged with Public Intoxication, failed to appear and a Capias was issued for his arrest.

• Jason Alexander Studivant, Speeding (70/55), violation of the Financial Responsibility law, failed to appear and a Show Cause was issued. 

Cynthia Denise Thomas, charged with Initiating Methamphetamine Manufacture, Maintaining a Dwelling for Methamphetamine Manufacture, Accessory After the Fact and Introduction of Contraband into a Penal Institution, was reset for Nov. 8.

Princess Odom had a Petition to Modify Sentence denied by Judge Melton.

Gary Riddle, charged with DUI 1st offense, was reset for Jan. 3.
