Excessive Noise Complaint Leads To DUI Charge

A Rogers Street resident faces a charge of driving while under the influence after leaving his home angry, upset, and allegedly intoxicated.

Jimmy L. Barnes II, 110 Rogers St., Woodbury, was charged with DUI on Oct. 4 after local law enforcement originally went to investigate a complaint of excessive noise.

According to the report filed by Cannon County Sheriff's Deputy Brandon Mims, Woodbury Police Patrolman Patrick Fann was dispatched to the Barnes residence in reference to the complaint. Upon Fann's arrival, Barnes had left the home.

Patrolman Fann advised over the radio that Barnes was driving a vehicle (1992 Dodge D15) with no tags and was reportedly under the influence. He also advised county deputies that Barnes was last seen headed up Highway 53S towards Manchester.

Deputy Mims along with Deputy Eric Moss found the vehicle Barnes was driving at the intersection of Hollow Springs Road and Highway 53S with Barnes behind the wheel, truck running, key in the ignition, and in a ditch.

Barnes had an odor of an intoxicant about his person, Mims' report states. A witness at the scene also smelled alcohol on Barnes.

Barnes was charged with DUI after he failed a series of field sobriety tests. He was also cited for driving an unregistered vehicle and no proof of financial responsibility.

He was released on $4,000 bond. Initial court date is Nov. 2, 2010.
